# Terms and Conditions

**Last updated: 11 October 2026**

## **Amendment to the Boost Fitness Terms and Conditions**

**Version:** 11 October 2026

This amendment is between Boost Fitness, the trading name of Mason Tustin, a sole trader in England whose business address is C/O D P C Stone House, 55 Stone Road Business Park, Stoke-On-Trent, Staffs, United Kingdom, ST4 6SR ("Boost", "we"), and you, the coach or business that holds a Boost account ("you"). It adds to the Terms and Conditions you already agreed to. Where the two disagree, this amendment wins.

### Part 1: What changes for you

**1.1 Clients choose what you see.** From Sunday 11 October 2026, what a client logs themselves is kept in their own Boost account. They choose what you see in eight categories: food, body (including intake answers), photos, metrics, Apple Health, workouts, habits and goals.

- New clients choose on one screen when they join you. Nothing is ticked for them. Until they choose, you see "Waiting for \<client> to choose what to share".
- Current clients choose the next time they sign in. Until then, clause 2.5 applies.
- Clients can change their choice at any time. When they turn a category off, you stop seeing it at once, including totals and analytics made from it.

**1.2 Your own coaching doesn't change.** Your programmes, workouts, habits, check-ins, forms, supplements, goals, meal plans and chat stay between you and your client. You see them as you do today.

**1.3 You see self-logged data only while a client is active.** If you pause or suspend a client, or they haven't confirmed you yet, you see nothing they log themselves. If you remove a client, or they leave you, their sharing ends at once. If they rejoin, they're asked again.

**1.4 Clients can have more than one coach.** You never see another coach's items, and you aren't told who the other coaches are.

- Your food library, recipes and meal plans stay with you. Another coach sees food from them only inside the client's day totals.
- Your own exercises appear to other coaches only as "Exercise".
- A client with more than one coach picks one nutrition coach. If they pause your nutrition plan, you see "Nutrition plan paused by \<client>", and those days are left out of your adherence, analytics and automations.

**1.5 What the item is decides who it belongs to.** A weigh-in or progress photo a client adds inside your check-in counts as theirs: you see it if they share body or photos with you. Their answers to your check-in are yours.

**1.6 Some coach controls change.**

- You can no longer edit or delete body stats a client logged themselves.
- The "Log their own activities" client setting goes. Clients can always log their own activities.

**1.7 Leaving.** Clients can leave you in the app or in your client area. Leaving has the same effect as you deleting the client:

- you stop seeing what they log themselves;
- we delete your coaching records about them: your plan for them and their logs of it, their check-in and form answers, and your check-in reviews, notes and files;
- your chat with them closes, and neither of you can open it again. We delete it 30 days later;
- what they started themselves stays in their own account if they've agreed to us keeping their diary; otherwise it's deleted with your records.

If they have paid access to your courses, they choose: leave now, which ends that access at once and stops their subscriptions renewing, or wait until the access ends. Leaving doesn't refund them; refunds are between you and your client. A client whose login was made for your website only can't leave their only coach; they can close their account instead. If you must keep records yourself, such as health screening answers for your insurer, keep your own copy while the client is with you.

**1.8 Account deletion.** A client can delete their Boost account in the app or in your client area. Their account closes at once, and we email you within one working day, with the date any subscription they pay you stops. Within 30 days we delete everything in it, including your coaching records about them (your plan and their logs of it, check-ins, form answers, chat, notes and files), apart from payment records, which we keep with their details removed. If you must keep records yourself, keep your own copy while the client is with you.

**1.9 The Boost Fitness iPhone app.** Your clients can use the Boost Fitness app as well as your website. It shows your name, logo and colours on your items. Boost, the app and your website's client area, is for people aged 16 and over (clause 2.4).

### Part 2: Data clients share with you

**2.1 Roles.** We are the controller of each client's own diary (the eight categories in clause 1.1) and their Boost account. When a client shares a category with you, you become a separate controller of what you see and use. Our privacy policy explains this to clients. For a client who was with you before 11 October 2026, our role as controller starts when they agree to us keeping their diary. Until then, what they log themselves stays your record, held by us as your processor (Part 3), and clause 2.5 says what you see.

**2.2 What you may do with it.** Use shared data only to coach that client. In particular:

- only you and your team may see it;
- don't sell it, give it to anyone else, or use it for advertising or to build marketing lists;
- don't try to find out who the client's other coaches are;
- if you copy anything out of Boost, delete the copy when the client stops sharing it with you or stops being your client, unless the law requires you to keep it;
- tell us without delay if you think shared data has been seen or used by someone who shouldn't have it.

**2.3 Health data.** Much of this is special category data under data protection law. The client's choice in Boost is their explicit consent to share it with you for coaching. Don't rely on it for anything else. We keep a record of each client's choices and will give you a copy for that client if you need to show their consent.

**2.4 Your own duties.** You must:

- read the privacy notice we generate from your business details, which we show on your website and in the app, and tell us if anything in it is wrong for your business. Tell your clients separately about anything you do with their data outside Boost;
- pay the ICO data protection fee, or register with your own data protection regulator, if the law requires you to;
- answer clients' requests about the records you control. We'll help (Part 3);
- not invite or coach anyone under 16 through Boost;
- if you're outside the UK, give your clients any extra notices your local law requires (for example, a consumer health data policy in Washington State).

**2.5 Existing clients on 11 October 2026.**

- Each current client's self-logged data stays your record, held by us as your processor (Part 3), and you keep seeing what you see today until that client chooses, or until they join another coach on Boost (then they're asked fresh for each coach). If a client withdraws their health-data consent, the carry-over ends and you instruct us, as your processor, to delete what they logged themselves, including entries from before 11 October 2026; your own plans, check-ins and chat are not affected.
- These clients are asked fresh instead of carrying over: a client with more than one coach; a client whose link to you we can't confirm; a client who isn't active on 11 October (paused, suspended or not yet confirmed); a client who later joins another coach on Boost (from that point); and a client who joined you on or after 11 October 2026 (they choose when they join, or at their next sign-in).
- Apple Health and a client's own habits never carry over.

### Part 3: Data Processing Terms

These terms are the processor contract that Article 28 of the UK GDPR requires, and Article 28 of the EU GDPR where it applies to you. They are also the processor contract that US consumer health data laws, such as Washington's, require.

**3.1 Scope.** They cover the personal data we process for you as your processor: your coaching records about your clients and leads, and, for each existing client until the carry-over in clause 2.5 ends for them, what that client logs themselves, as described in Annex 1. Otherwise they don't cover a client's own diary or Boost account (Part 2).

**3.2 Instructions.** We process this data only on your documented instructions. Your instructions are these Terms, and what you do in your dashboard. The agreed instructions include deleting a client's records when they leave you (clause 1.7) or delete their Boost account (clause 1.8). We'll tell you if we think an instruction breaks data protection law. If the law makes us process data another way, we'll tell you first unless the law forbids it.

**3.3 Confidentiality.** Everyone who processes this data for us is bound to keep it confidential.

**3.4 Security.** We keep the measures in Annex 2 in place and may improve them. We won't make them weaker.

**3.5 Sub-processors.** You give us general permission to use the sub-processors listed in Annex 3.

- We'll tell you at least 30 days before adding or replacing one, by email or in your dashboard.
- If you object on reasonable data protection grounds, tell us within those 30 days. If we can't solve it, you may end your subscription and we'll refund any prepaid, unused period.
- Each sub-processor is bound by data protection terms at least as protective as these. We're responsible for what they do.

**3.6 Clients' rights.** We give you tools to find, export, correct and delete client records. If a client asks us directly about your records, we'll pass it to you within 5 working days, and help you answer.

**3.7 Breaches.** If we become aware of a personal data breach affecting your data, we'll tell you without undue delay, and within 48 hours. We'll give you what we know and update you as we learn more.

**3.8 Other help.** We'll give you reasonable help with security, breach notifications, data protection impact assessments and talks with the ICO or another regulator, as far as they concern our processing.

**3.9 Transfers.** We keep the database and files in London. Where a sub-processor processes data outside the UK, we use a transfer mechanism UK law allows (an adequacy decision, the UK Extension to the EU–US Data Privacy Framework, or the UK International Data Transfer Agreement or Addendum). For data that comes from the EU or EEA, we rely on the EU's adequacy decision for the UK and, for onward transfers to a sub-processor, the EU–US Data Privacy Framework or the EU Standard Contractual Clauses.

**3.10 At the end.** When you close your Boost account, we delete your data within 30 days, unless the law requires us to keep it. You can export what you need before closing. Your clients' memberships with you end. Their own Boost accounts stay, and so does what they started themselves if they've agreed to us keeping their diary; otherwise it's deleted with your data. Payment records are kept with personal details removed.

**3.11 Information and audits.** We'll give you the information you need to show these terms are met. If that's not enough, you may audit us once a year, or more often if a regulator asks you to or after a personal data breach affecting your data, on 30 days' notice, at your cost, without seeing other customers' data. We may first answer with documents.

**3.12 Liability.** The limit in section 9.3 of the Terms, as clause 4.3 amends it, applies to this Part.

### Part 4: General

**4.1 When this takes effect.** This amendment applies to every coach under section 13 of the Terms ("Changes to Terms"), whether or not you click accept, from Sunday 11 October 2026. We're telling every account owner by email and in the dashboard. If you keep using Boost after 11 October 2026, you accept it. You don't need to click accept for this amendment to apply; accepting in your dashboard records that you've agreed. If you don't want these terms, you can cancel your subscription at any time. If you're on a yearly plan and cancel by 21 November 2026, we'll refund the months you haven't used.

**4.2 Governing law.** The Terms and this amendment are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction. This replaces section 12 of the Terms ("Dispute Resolution"), including its arbitration clause.

**4.3 Liability.** Nothing in the Terms or this amendment limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else the law doesn't allow to be limited. The limit in section 9.3 of the Terms applies only between you and us. It doesn't limit what either of us owes your clients or anyone else under data protection law.

**4.4 Transfer.** We may transfer the Terms, including this amendment, to a company we set up to run Boost Fitness or that takes over the Boost Fitness business. We'll tell you at least 30 days before. Your rights under the Terms won't be reduced.

### Annex 1: Processing details

| --- | --- |
| Subject matter | Running your coaching business on Boost |
| Duration | While you have a Boost account, then clause 3.10 |
| Nature | Storing, organising, showing, sending, analysing and deleting |
| Purpose | Providing Boost's services to you: client area, app, programmes, check-ins, forms, chat, bookings, payments, analytics, automations and AI features you use |
| Data subjects | Your clients, leads, website visitors and team |
| Personal data | Names, contact details, profile details, coaching records (programmes, logs of your workouts, habits, check-in and form answers, supplements, goals, meal plans), chat messages, voice notes and attachments, bookings, purchases and payments, your notes, analytics about your clients; and, until the carry-over in clause 2.5 ends for an existing client, what that client logs themselves (food, body and intake answers, progress photos, metrics, workouts and goals) |
| Special category data | Health data: answers to your health questions, check-ins and forms, medical and emergency details, clients' logs of your workouts and habits, and nutrition in your meal plans, items and supplements; and, until the carry-over in clause 2.5 ends for an existing client, the health data in what that client logs themselves (food, body and intake answers, progress photos, metrics, workouts and goals). Otherwise, weigh-ins and progress photos a client adds inside your forms are not included: they belong to the client's own diary (clause 1.5, Part 2). |

### Annex 2: Security measures

- Database and files hosted in London (Supabase, region eu-west-2). Servers in London (Vercel, lhr1).
- Encryption in transit (TLS) and at rest.
- Row-level security in the database for every client table. One predicate decides what a coach can see of a client's own data. Automated tests check coach, client and category combinations before release.
- Two-step login for coaches.
- Staff access limited to what support needs. Staff sessions on a customer account are minted by our server and recorded in an audit log. From them, staff can't change a client's sharing choices, answer the age question, leave a coach or delete an account.
- Email addresses, tokens and keys removed from error logs.
- Bot checks, or per-address and per-IP rate limits, on every sign-in and sign-up route.
- Daily backups.

### Annex 3: Sub-processors

| **Sub-processor** | **Purpose** | **Location** |
| --- | --- | --- |
| Supabase | Database, sign-in, file storage | UK (London) |
| Vercel | Hosting, bot checks, cookie-free page counts, AI gateway | UK (London); global edge |
| OpenAI, Microsoft Azure, Amazon Bedrock and Google (Gemini API and Vertex AI), via Vercel's AI gateway | AI features: imports of workouts, recipes and client lists, the weekly client to-do list, documents, ad analysis. OpenAI's models are the main ones; Google's Gemini is the back-up for some features. None of them uses this data to train AI models (privacy policy, section 7). | USA and other countries |
| Resend | Emails sent for you to your clients | USA |
| Loops | Emails from Boost | USA |
| PostHog | Fault diagnostics on the web | EU (Germany) |
| Apple | Push notifications | USA |
| Amazon Web Services | Ad images and videos | Sweden |
| Google (Google Workspace) | Support email | USA and other countries |
| Asana | Support case tracking | USA |

Stripe (payments on your own account) and Meta (your connected ad accounts) are separate controllers under their own terms with you, not our sub-processors.
